CCP Approves CCP-Licensed CO₂ Plant Acquisition by Pak Arab Fertilizers

The (CCP) has approved the proposed acquisition of the liquid carbon dioxide (LCO₂) plant of Pakistan Oxygen Limited by Pak Arab Fertilizers Limited. This approval follows a Phase-I review under the Competition Act, 2010.

Pak Arab Fertilizers Limited, a wholly owned subsidiary of Fatima Fertilizer Company Limited, is involved in manufacturing and selling fertilizers and chemicals. The target company, Pakistan Oxygen Limited, specializes in industrial and medical gases production.

The Commission’s assessment found that the transaction involves a horizontal merger with limited impact on market share and competitive conditions. No evidence indicated that the acquisition would lessen competition or significantly enhance market power.

The CCP determined that the proposed transaction does not create or strengthen a dominant position within the meaning of the Competition Act, thus granting approval under Section 31(1)(d)(i) of the Act. This decision underscores the Commission’s commitment to protecting competition and consumer welfare while facilitating legitimate business transactions.
