Prosecutor Laura Buchan stated that Lee Milne physically and psychologically abused Kimberly. He exploited her vulnerabilities, making him responsible for her decision to end her life.

Evidence showed Lee Milne’s control over Kimberly during their 18-month marriage. He choked, punched, and restrained her, belittled her, limited her access to money and transportation, and locked her in the apartment without food.

Judge Lorna Drummond emphasized that domestic abuse is about power and control, not just violent acts. She noted that each act of abuse adds to the next, increasing pressure and fear.

The family was devastated by Kimberly’s death. Four months before her suicide, she had urged her sister to leave Lee Milne.

On the day of her death, surveillance video showed Lee Milne speeding his car at Kimberly from behind in a parking lot and narrowly missing her. She then threw herself onto the highway below.

Drummond stated that the jury must bear responsibility for all abusive acts and causing her death.
