Federal Constitutional Court Directs Response on “Release Force” Proposal

The Federal Constitutional Court (FCC) has ordered Khyber Pakhtunkhwa Chief Minister Sohail Afridi to respond within 10 days to a petition challenging the proposed mobilization of a “release force” for jailed Imran Khan.

Court Issues Notices to Key Respondents, Including KP Government and PTI

The three-judge bench headed by Chief Justice Aminuddin Khan also issued notices to the federal government, Pakistan Tehreek-e-Insaf (PTI), and the Election Commission of Pakistan. The petition was filed by Advocate Ali Nawaz Kharal, arguing that any formation or mobilization of private force would violate constitutional provisions, particularly Article 256.

Court Instructs Federal Government on Public Safety

The court also instructed the federal government to ensure no laws are violated and public safety is maintained during this process. The proposed “release force” was announced by CM Afridi in February following failed protests for a meeting with Imran Khan, who has been imprisoned since August 5, 2023.

Petition Raises Concerns Over Public Order and National Integrity

The petition argues that such a move could create fear and unrest among the public and draws parallels with past militant political wings. It maintains freedom of association is protected under Article 17 but subject to restrictions in interest of public order and national integrity.
