Punjab Approves Special Security Trial Framework for High-Risk Terror Cases

Punjab Approves Anti-Terrorism Act Amendments

The Punjab government has approved an addition, Section 21AAA, to the Anti-Terrorism Act, 1997. This introduces a separate judicial procedure for high-risk terrorism cases.

Special Security Cases

These cases may be declared by a designated authority where exceptional security threats are identified. For such cases, a special judge from among Anti-Terrorism Court judges will be nominated by the Chief Justice of Lahore High Court.

Prosecution Mechanism

The Prosecutor General Punjab is required to submit a panel comprising five prosecutors for appointment of one prosecutor to conduct the case in Special Security Cases.

Witness Safety Measures

Individuals appearing in court will be assigned specific identification codes instead of using their real names. The judicial record and identities of witnesses will remain sealed, with technology used to conceal where necessary.

Secure Proceedings

Proceedings in Special Security Cases are only allowed at secure locations. Courts must maintain special security equipment and enhanced protective arrangements. Virtual trials from prisons may also be conducted when required.

Designated Authority

A Grade-20 or higher officer will be appointed as the designated authority, with power to consult the Chief Justice of Lahore High Court on relevant matters. The authority determines if a case is a Special Security Case and oversees its implementation.
