Approves Acquisition
The (CCP) has approved the proposed acquisition of the liquid carbon dioxide (LCO₂) plant by Pak Arab Fertilizers Limited from Pakistan Oxygen Limited. The approval was granted following a Phase-I review under the Competition Act, 2010.
Pak Arab Fertilizers Limited, a wholly owned subsidiary of Fatima Fertilizer Company Limited, is involved in manufacturing and selling fertilizers and chemicals. Pakistan Oxygen Limited specializes in industrial and medical gases production.
The CCP’s assessment found that the transaction involves a horizontal merger with limited impact on market share, competition dynamics, or market concentration. No evidence indicated that the acquisition would lessen competition or significantly enhance market power.
The Commission concluded that the proposed transaction does not create or strengthen a dominant position within the meaning of the Competition Act, 2010 and granted approval under Section 31(1)(d)(i) of the Act. This decision reflects the CCP’s commitment to protecting competition, market efficiency, and consumer welfare while facilitating legitimate business transactions and investment activity.
